trade mark and domain databases

Introduction

Marquesa provides two distinct types of database: MQ databases and Patent Office direct databases. MQ databases are indexed by Marquesa and hosted on our own servers; 'direct' databases are online databases provided by various Patent and Trademark offices around the world. MQ databases are accessible via the Browser and the MqPro interface and are indexed comprehensively. Direct databases are currently only available via MqPro and there are indexing restrictions which vary from country to country.

Because trade mark regimes overlap (e.g. the Community Trade Marks apply to all EU Member States) so they must be searched together with the National Marks for a particular country. There are other regimes which overlap, in particular the International Marks which designate particular countries. In the case of the UK,US and Ireland these International Madrid marks are included in the National Databases so needn't be searched separately; however in the case of Germany they are not included in the database we provide so a search of marks relevant to Germany must include the IR - DE (the subset of the IR database consisting of marks designating Germany). In 2004 it became possible to apply for International marks designating the EU as a whole; these IR - EM marks which perhaps rightfully should be part of the CTMs, are not included there so must be searched separately. Other overlapping regimes arise from e.g. the Paris Convention ( which gives special protection to Flags, Armorial Bearings, Hallmarks, names of International bodies etc..), the World Health Organisation's mandate (which gives special protection to International Non-Proprietary Names (INNs), and many other directives, conventions and agreements. 21,000 names protected in this way are included in the Reserved Words database. More will be added (e.g. USBANs).

[UK] United Kingdom Trade Marks

  • The text of the United Kingdom marks is provided by the UK Patent Office from their OPTICS databases run by the Department of Trade and Industry mainframe at Cirencester.
  • The images of marks are provided by the UK Patent Office TRIMMS databases run at their Newport offices.
  • The Madrid protocol marks designating the UK are provided by WIPO via the UK Patent Office.
  • The history data is generated automatically by Marquesa Search Systems Ltd.
  • The pre-searched sets such as UPDATE are generated by Marquesa Search Systems Ltd.
  • N.B. Excludes International Marks designating the EU.

[CM] European Community Trade Marks

  • Text and images of the CTM are provide by OHIM in Alicante, Spain.
  • History data is generated automatically by Marquesa Search Systems Ltd.
  • Pre-searched sets such as UPDATE are generated by Marquesa Search Systems Ltd.
  • N.B. Excludes International Marks designating the EU.

[US] USA Federal Trade Marks

  • All data is obtained from TESS and other searching services provided by the USPTO.
  • Includes Madrid marks (Application numbers prefixed M).

[DE] German Trade Marks

  • The German database and updates are sourced from Schutz Marken Dienst GmbH.
  • The history data is generated automatically by Marquesa Search Systems Ltd.
  • The pre-searched sets such as UPDATE are generated by Marquesa Search Systems Ltd.
  • N.B. Excludes Madrid marks and International Marks designating the EU.

[IR] International Trade Marks includes IR - EM marks, see below

  • The text and images of the International Marks are supplied by WIPO.
  • The history data is generated automatically by Marquesa Search Systems Ltd.
  • The pre-searched sets such as UPDATE are generated by Marquesa Search Systems Ltd.
  • The International marks designating the European Union are a very important subset of the IR database. Notated as IR - EM in Marquesa, this subset of the IR database must be included in all searches of any EU country's marks because they are not included in the CTMs or in any of the country databases.

[IE] Irish Trade Marks

  • Text and images are provided by the Irish Patent Office and include the Madrid marks which have Application numbers prefixed by M.
  • The Database includes Government of Ireland Copyright material. Government of Ireland Copyright 1988.
  • The history data is generated automatically by Marquesa Search Systems Ltd.
  • The pre-searched sets such as UPDATE are generated by Marquesa Search Systems Ltd.
  • N.B. Excludes International Marks designating the EU.

[CD] Community Designs

  • The descriptive text and images are provided by OHIM.
  • The history data is generated automatically by Marquesa Search Systems Ltd.
  • The Vienna Codes are provided by Marquesa.
  • The words and associated indexes are provided by Marquesa.
  • The pre-searched sets such as UPDATE are generated by Marquesa Search Systems Ltd.

[RW] Reserved Words

  • The Reserved Words consists of over 21,000 devices and words which are protected under: Article 6 ter of the Paris Convention, The World Health Organisations agreed list of International Non-Proprietary Names (INNS), British Approved Common Names (BANs), European Geographic Indications and Designations of Origin (GIs and DOs), The European Union's list of Protected Names for Wine Sector Products originating in the Community (EC regulations 2081/92, 1493/99 and 1576/89.) also European Union's list of Protected Names for agricultural and ornamental plants and fruits, Protected names of the International Olympic Committee.
  • The Art 6 ter data Consists of over 1000 flags, royal insignia, images and names of international organisations, the images are provided by WIPO.

[UKDOM] United Kingdom Domain Names

  • The list of UK internet domains is provided by Nominet, the official registrar.
  • The list covers .co.uk, .org.uk, .ltd.uk, .plc.uk, .me.uk & .net.uk domains.
  • The history data is generated automatically by Marquesa Search Systems Ltd.
  • The pre-searched sets such as UPDATE are generated by Marquesa Search Systems Ltd.
